Please read this agreement carefully before using this product. By using this equipment, you acknowledge that you have read, understood, and agreed to all the terms and conditions contained herein, and you consent to be legally bound by this agreement and special order-contract between Seller and Buyer

Manufacturer Warranty
Cryonick Wellness technology Factory/ VACUACTIVUS Medstarcom, as a manufacturer of fitness and spa equipment, warrants that all new products are free from defects in materials and workmanship for the warranty period specified below. The warranty period begins on the invoice date of the original purchase.

This warranty applies only to defects discovered within the warranty period and extends solely to the original purchaser of the product. Parts repaired or replaced under this warranty are covered only for the remainder of the original warranty period.

To submit a warranty claim, the Buyer must notify Cryonick Wellness technology Factory/ VACUACTIVUS Medstarcom or its authorized distributor within 10 days of discovering the nonconformity and must make the affected product available for inspection by Cryonick Wellness technology Factory or its authorized service representative. The Manufacturer’s obligations under this warranty are strictly limited as outlined below.

Warranty Coverage

All Cryonick Wellness technology Factory products include a standard one (1) year manufacturer’s warranty, which covers the body, motors, and parts of the equipment.

Clients may also elect to purchase an optional extended warranty service plan up to 3 years for continued coverage after the expiration of the standard warranty, but such election needs to be completed not later than 10 days after purchase.

Warranty Terms
Warranty Coverage
The Manufacturer of Cryonick Factory fitness and spa equipment provides the following limited warranty, effective from the date of invoice, subject to proper use in accordance with the instruction manual:

Structural Frame / Body: 1 year

Motors: 1 year

Mechanical and Electrical Parts: 1 year

Product Labor: 1 year

High-Wear Console Items (headphone jacks, USB connectors): 90 days

Touch Screens / Media Connectors (color or other types): 90 days

An optional extended warranty technical support plan is available upon request on date of purchase

Warranty Service
The Manufacturer undertakes to remedy, free of charge, any defects discovered during the warranty period.

For minor irregularities, replacement parts and instructions will be provided to minimize downtime.

For serious malfunctions, the Manufacturer will dispatch either its own service team or an authorized service representative to complete the repair.

Repairs will be completed within 90 days of the date of proper notification.

Maintenance Recommendation
For safe and reliable operation, devices and their electrical systems should undergo periodic inspections and maintenance at least once every four (4) months. Failure of maintenance records completed by authorized party is a subject of warranty limitation or cancellation.

Warranty Exclusions
This warranty does not cover defects or damages resulting from:

Improper handling, misuse, or operation contrary to the intended purpose.

Acts of force majeure (e.g., fire, flood, lightning).

Mechanical damage caused by external forces.

Modifications, alterations, or unauthorized repairs.

Relocation, disassembling, assembling or installation (reinstallation) of equipment by unauthorized third parties or customer self installation.

Damage due to broken or tampered warranty seals.

Improper connection to electric line which does not fit manufacturer’s requirement
Non-Covered Components
The warranty excludes:

Consumables and Wear Items: connecting cords, plugs, sockets, switches, buttons, batteries, cables, wire covers, belts, pedals, massage mats, decorative strips, aroma containers, etc.

Naturally Wear-Prone Components: strips, bearings, ropes, springs, pulleys, hinges, wedges, screw connections, hydraulic parts, leather surfaces, wooden panels or bottoms, pillows, chairs, and other elements subject to natural wear and tear.

Unless otherwise specified, defects in these components that are caused by normal wear are not covered under this warranty. Only failures due to inherent material or manufacturing defects are considered for review.

Warranty Exclusions and Limitations
This limited warranty does not apply to the following:

Software and Digital Systems

Any software updates.

Software defects that do not materially and negatively affect the exercise functionality of the product under normal use conditions at the time of installation.

Consumable and Cosmetic Items

Consumable goods and cosmetic parts, including plastic or painted surfaces, that are damaged or defaced due to abuse, misuse, accident, improper service or installation, mishandling, or unauthorized modification.

Cosmetic, structural, or functional damage (including rust, corrosion, or unusual wear) resulting from failure to follow the maintenance procedures described in the product documentation.

Unauthorized Repairs or Alterations

Repairs performed on Factory equipment without a valid serial number or where the serial tag has been altered or defaced.

Use or incorporation of any non-OEM (Original Equipment Manufacturer) replacement parts.

Modifications or design changes made by the user or unauthorized third parties.

Service and Maintenance Exclusions

Service calls for correcting improper installation or to instruct users on basic operation of the equipment.

Pickup and delivery charges related to repairs.

Any labor costs incurred beyond the applicable labor warranty period.

Failure to use required consumables (e.g., non-grease damage to cable raceways).

Components Not Covered

RFID tokens.

Cable raceway and fuse systems.

Damage from External Factors

Mechanical damage caused intentionally or unintentionally by external forces.

Thermal, chemical, or other damage from external factors beyond the Manufacturer’s control (including but not limited to power surges, lightning, flooding, or other force majeure events).

Improper protection of equipment from environmental factors such as humidity, temperature, or foreign objects.

Operation of equipment despite known faults or damage.

Improper Use

Damage resulting from use inconsistent with the instruction manual.

Damage caused by improper installation, relocation, or modification of installation settings.

Damage caused by misuse, neglect, or deliberate actions by the user or third parties.

Technical support is available Monday to Friday, 10:00 AM – 5:30 PM (Pacific Time or Central European Time), subject to availability.
Service must be booked in advance by contacting VACUACTIVUS via phone or email.
Warranty service will be provided at the sole discretion of the Manufacturer. If the issue can be resolved by replacement parts, and installation is
straightforward, parts will be shipped without dispatching a technician.
The warranty period begins on the date of purchase, not the date of delivery or installation.
The Manufacturer does not reimburse or compensate for services performed by unauthorized or third-party technicians, any missed parts or accessories if
equipment is installed by customer or third party

Warranty Conditions & Restrictions
This warranty is valid only under the following conditions:

The product was originally installed and serviced by a Factory Authorized Service Provider and/or Certified Distributor.
Equipment installed or serviced by unauthorized parties, or self-installed by the Buyer, voids the warranty for the entire product.
The product remains in the possession of the original purchaser with proof of purchase available.
The product has not been subjected to accident, misuse, abuse, improper service, or unauthorized modifications.
Claims are made within the warranty period.
The warranty does not cover:
Damage caused by electrical wiring not compliant with local codes or Factory specifications.
Failure to perform reasonable and necessary maintenance as described in product documentation.
Internet connectivity, ISP service, routers, cabling, or media input compatibility.
Changes in broadcast standards, signal quality issues, or compatibility with future services.
Accuracy of heart rate monitoring systems (subject to user physiology and external factors).
Third-party products, applications, or accessories (e.g., speakers, cables, low-voltage wiring).
Labor performed outside manufacturer-authorized locations.
Equipment installed outside the country of purchase.
Moving parts bolted to the structural frame (e.g., arms, seat/back pads, cross-ramps, position adjustments) are excluded from the “Structural Frame” warranty.

Disclaimer & Release of Liability
The warranties herein are the exclusive warranties provided by Factory and supersede all prior oral or written representations.

Any implied warranties (merchantability, fitness for purpose) are limited in duration to the express warranty periods above.

Factory disclaims all liability in tort or otherwise for:

a) Nonconformity or defect beyond express warranty terms.
b) Damage to property or equipment.
c) Loss of revenue, profit, or substitute equipment costs.

Order-contract shall be construed according to the laws of the State of California in effect as of the date of execution. Any action initiated in connection with any matter arising out of purchase contract shall be exclusively filed in the Los Angeles Superior Court for the County of Los Angeles, State of California (Stanley Mosk or Van Nuys locations) or Western Division of United States federal district court of California only. Purchase contract is made and shall be enforced as provided under the laws of the State of California only. Equipment Purchase, Use & Liability Waiver Policy
1. Assumption of Risk
By purchasing, leasing, installing, operating, or allowing others to use the equipment, the Client/Owner acknowledges and agrees that the use of the equipment is entirely at the Client’s own risk. The Client understands that the equipment involves physical activity, mechanical operation, and potential risks that may result in injury, illness, property damage, or death.

2. Release and Waiver of Claims
The Client hereby fully releases, waives, discharges, and holds harmless the Manufacturer, including its owners, officers, directors, employees, agents, contractors, affiliates, and related parties, from any and all claims, demands, damages, losses, liabilities, actions, or causes of action, whether known or unknown, arising out of or related to:

use or misuse of the equipment

installation or relocation of the equipment

operation or supervision of the equipment

injuries to users, employees, clients, or third parties

property damage

equipment malfunction or alleged defect

3. Indemnification
The Client agrees to defend, indemnify, and hold harmless the Manufacturer and its related parties from and against any claims, lawsuits, costs, damages, penalties, or attorney fees arising from:

operation or use of the equipment

injuries or damages suffered by the Client or any third party

failure to follow operating instructions, safety guidelines, or maintenance requirements

improper installation, modification, repair, or relocation

All claims related to equipment use shall be directed solely to the equipment owner/operator and may not be transferred, assigned, or forwarded to the Manufacturer.

4. No Responsibility for Improper Use or Installation
The Manufacturer shall have no responsibility or liability for:

improper or unsafe operation

lack of supervision

unauthorized modifications

installation performed by third parties or the Client

failure to comply with local laws, safety rules, or operating instructions

The Client is solely responsible for ensuring proper installation, training, supervision, and safe operation of the equipment.

5. Insurance Requirement
The Client acknowledges and agrees that they are solely responsible for maintaining adequate general liability insurance, professional liability insurance, or other applicable coverage that includes equipment operation and user injury liability. The Manufacturer does not provide insurance coverage for the Client’s use or operation of the equipment.

6. No Medical or Safety Guarantees
The Manufacturer does not provide medical advice, health guarantees, or safety assurances regarding outcomes, user tolerance, or suitability of the equipment for specific individuals. All users must consult with qualified professionals before use if required by law or best practice.

7. Limitation of Liability
To the maximum extent permitted by law, the Manufacturer shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, business interruption, or reputational damage, even if advised of the possibility of such damages.

8. No Reliance on Verbal Statements
The Client agrees that the Manufacturer shall not be bound by any verbal statements, representations, or assurances made by employees, agents, distributors, or third parties unless explicitly stated in writing within the official terms, warranty, or policies published on the Manufacturer’s website or included in the sales agreement.

Any statements that conflict with or exceed the published policies and terms are void and non-binding.

9. Governing Law & Jurisdiction
This policy shall be governed by and interpreted in accordance with the laws specified in the Manufacturer’s Terms & Conditions. Any disputes shall be resolved exclusively in the designated jurisdiction stated therein.

10. Acceptance of Terms
By purchasing, accepting delivery, installing, operating, or using the equipment, the Client confirms that they have read, understood, and agreed to this policy in full and accept all associated risks and responsibilities.

Exclusive Remedies
If a product fails to conform to warranty terms, the Manufacturer, at its sole discretion, will provide one of the following remedies:

Repair of the product.
Replacement of the product.
Shipment of replacement parts with instructions.
Refund of the purchase price.
Warranty service is provided through Authorized Service Centers or Certified Distributors. Authorized Servicers are compensated for warranty service within their
normal service areas. Additional trip charges may apply outside those areas.

Exclusion of Consequential and Incidental Damages
The Manufacturer and its suppliers shall not be liable for incidental, indirect, or consequential damages, including but not limited to:

Equipment damage,
Property damage,
Loss of use, revenue, or profit,
Costs of substitute equipment,
Additional costs incurred by the Buyer.
This exclusion applies even if the warranty fails in its essential purpose.

Warranty and Payment Status
All warranty and technical support, and customer service are automatically canceled if the Buyer fails to pay the full order amount or service charge within 20
days of delivery or installation.

Once canceled, warranty coverage cannot be restored, even if the balance is later paid.

To receive technical support after cancellation, the Buyer must:

Pay the full outstanding balance,
Sign a special service agreement, and
Provide a deposit for technical support.
The Manufacturer assumes no liability for technical issues or equipment operation once warranty and technical support coverage is canceled due to non-payment.

Final Provision
This warranty and support policy is provided at the sole discretion of the Manufacturer and is a subject to change or withdrawal at any time without notice. By receive or sign purchase order-contract Buyer agreed with Manufacturer/Seller terms described above.

Order Processing 

Once your order is placed, you will receive an order confirmation email confirming that we have received and begun processing your order.

Stock availability is confirmed after purchase:

  • In stock: Your order will be prepared and shipped.

  • Out of stock/backorder: We will contact you with available options, which may include an estimated restock date, an alternative product, or a refund if you choose not to proceed.

You will receive email updates throughout the process, including tracking details once your order ships.

Cancellations within 24 hours may be approved at our discretion only if the order has not been placed/paid with the supplier or shipped.

Returns

Returns are accepted within 7 days of delivery for most products. All approved refunds are subject to a 25% restocking fee, and all shipping and any white-glove delivery costs are non-refundable.

After 7 days, and up to 14 days from delivery, eligible orders may be exchanged only, subject to the same condition requirements.

Certain products, including pre-orders, backorders, custom items, and select brands, are final sale and not eligible for return, refund, or exchange. After 14 days from delivery, all sales are final.

Condition of Returns

Returned items must be unused, in their original packaging, and include all accessories, components, and documentation. Return shipping costs are the customer’s responsibility and are non-refundable.

Pre-Orders & Backorders

Pre-orders and backorders are paid in full at the time of purchase to secure inventory that is specifically allocated to your order.

Once placed, we immediately commit funds with our suppliers and reserve inventory. For this reason, pre-orders and backorders cannot be cancelled and are non-refundable once confirmed.

Estimated shipping timelines are provided in good faith. Delays may occur due to factors outside our control, including manufacturing schedules, supplier availability, or freight and logistics issues.

If an exception is approved at our sole discretion, a cancellation and restocking fee will apply and will be deducted from any approved refund.

Defective or Damaged Items

If an item arrives defective or damaged, the manufacturer will offer a replacement at no cost. Issues must be reported within 24 hours of delivery.

A replacement requires the defective item to be returned before a new unit is shipped. A prepaid return label will be provided for approved claims.

If you decline a replacement and request a return instead, the request will be handled under the standard return policy, including a 25% restocking fee and non-refundable shipping costs.

Damage not reported within 24 hours may not be eligible for a claim.

Missed Deliveries & Refused Shipments

Large or freight items are delivered to the address provided at checkout and are typically not returned to sender. Tracking details will be provided.

If an order is refused at delivery or returned to the sender, a 25% restocking fee will apply, and you are responsible for all outbound and return shipping costs.

All products are covered by the manufacturer’s warranty, which varies by brand.
We can provide proof of purchase and assist with documentation; however, warranty claims are handled directly by the manufacturer.

After the return period, repair or replacement decisions are subject to the manufacturer’s warranty terms and may require return of the defective item.
